北市河濱公園球場過去開放讓民眾免費使用,但近年卻遭各大體育協會以認養、辦比賽等
名義長期霸佔,甚至拿公家地開班授課,形同做「無本生意」,為了「還地於民」,北市
體育局祭出新制,從今年3月開始,河濱公園棒壘球場、橄欖球場與足球場將全面改「收費
制」,藉此解決各大體育協會的侵占行為。
市府人員坦言,目前多個河濱球場都有遭地方體育協會占用情況,有協會以「認養」或「
辦比賽」的名義,優先向體育局取得使用權,一口氣霸佔多個時段,甚至有協會佔地為王
,將整個球場納為己用。
原先市府建置了北市公有場地租借系統租借,讓所有市民可登記使用,但因為上述種種行
為,導致時段全部都被提前借走。更離譜的是,有些協會占用球場後還開班授課、收費舉
辦賽事,所有營收順利成章的進到自己口袋,形同拿公家土地做無本生意。此外這些協會
跟當地議員交情匪淺,若遭市府稽查還會出動民代出面撐腰。
北市體育局長李再立證實,從今年3月開始,河濱棒壘球場、橄欖球場與足球場將全面收費
,這是體育局新制,且已報議會備查同意,屆時收費將分兩種,如果是白天就單純收場地
使用費,若是夜間比賽還要加收照明費。若活動屬公益性質,場地費部分就可以減免。但
如果是非公益性質、有收費的活動,全部都要繳錢。
李再立表示,體育局的租借系統會顯示那些單位租借那些時段,新制上路後因為要全面收
費,相信有些單位就把不用的時段釋放出來,「因為他不放出來就要付錢給我們,這樣一
般市民就可以上去借用」。至於那些場地有被占用情形,他表示並未處理這樣問題。
至於未來收費標準?體育局設施專員黃美玲表示,體育局將針對獨占性場地收費,未來棒
壘球場白天每小時270元、夜間收費400元(照明),11人制足球場白天收費260元、夜間收費
300元,5或7人制足球場白天收費190元、夜間收費250元,橄欖球場白天收費240元、夜間
收費250元。
先前北市公園處才發生陽明山國際大飯店侵占公有地遭檢方調查,北市政風處長沈鳳樑指
出,若有長期侵占行為,在法律上已構成刑法《竊占罪》,不但違法還可以追討五年不當
獲利,屆時北市府可依公告地價去討錢。若是短期(每周一兩小時)行為,雖然沒有構成侵
占,但如果市民想要使用該場地,結果有人因為教學把他人趕走,也可能涉及《強制罪》
問題,也呼籲大家遵守法令。
