A re-entry ban, also known as an exclusion period, means a person may not be
able to return to Australia for up to three years. A re-entry ban may be
imposed when a person breaches their visa conditions.

A re-entry ban will apply, if:

you overstay your visa by more than 28 days
your visa is cancelled because:

> you provided false documents or false information to the Department of Home
Affairs
> you are considered to be a risk to the health, safety or good order of the
Australian community


> you are convicted of an offence against a law of the Commonwealth, or a law
of an Australian state or territory
> you are found to have breached a visa condition, for example, you worked
when your visa had a no work condition
> you hold a student visa but have failed to maintain appropriate enrolment,
breached another visa condition, or have been found not to be a genuine
student
> you hold a visitor visa but were found not to be in Australia as a genuine
visitor.

We might apply a re-entry ban (exclusion period) if you:

> don't comply with your visa conditions
> don't leave Australia before your visa expires
> don't maintain a valid visa while in Australia
> don't comply with immigration law, or provide false information or
documents to the Department


Make sure you know when your visa expires and what your visa conditions are.
Check your visa expiry date and conditions in VEVO or your visa grant letter.

If we cancel your visa we will tell you what exclusion period we have applied

Ask us to waive your re-entry ban (exclusion period)

For temporary visa applications

We will not remove a re-entry ban, but you can ask us to set it aside if you
apply for a new temporary visa.

Explain to us, in writing, why we should put the ban aside. You must show us
that there are compassionate or compelling circumstances to put aside your
re-entry ban and grant you the visa. If you can't, we will refuse your
application.

那澳洲政府不會幫你把你的禁令時間縮短，但是你可以申請另外一種 Visa 進來。
但是你必須要書面提供足夠且誠懇的理由告訴澳洲政府為什麼要把這禁令擱置。

Your visa was cancelled because the Minister was satisfied that your presence
in Australia is or may be, or would or might be, a risk to the health, safety
or good order of the Australian community or a segment of the Australian
community or the health or safety of an individual or individuals (section
116(1)(e) – click here to learn more).

However, you will not be affected by PIC 4013(1A) 3 Year Ban on Visa if the
section 109 cancellation decision is set aside by the AAT or court; or the
Minister revokes the cancellation under the Minister’s power under s 133A(3)
(personal powers to cancel under s 109 grounds or under public interest) or s
133C(3) (personal powers to cancel under s 116 grounds or in the public
interest); or the cancellation decision under s 116, s 128, s 133A or s 133C
is set aside by a court; or the s 128 cancellation is revoked under s 131
(but this does not mean that visa was never cancelled: s 133(1)).

其實如果 Djokovic 第一次被取消 Visa 後直接離開的話，他的禁止進入時間是會按照
通知單上面的時間 (最高罰則三年)。那如果在恢復 Visa 後直接離開的話，則是不會被
罰。但是他後面這次是被移民部長直接用 4013(3) 取消，那就是三年。

當然，移民部長也可以隨時把這條個人禁令收回，那就要看他要不要收回 (或者等下一
任移民部長？)。

上次看法令寫不能上訴可是澳洲法院還是為了他開了一個聽證會，所以會不會有
特殊待遇那是很難說啦！雖然最後法院結論是不準再上訴...

不過這三年內他還是可以另外申請別的 Visa，只要他有足夠的理由可以讓澳洲同意。
